Clicking "Empty Trash", in fact, does not mean to erase the files themselves but instead the hard drive's directory entries for the files that were in your Mac Trash bin. This means those deleted files are still at somewhere on the hard disk and you can't see them with your naked-eyes.
Misunderstanding: you are entirely wrong if you think data can never be retrieved once it has been emptied from the Trash Bin. You can recover deleted files, photos or data as long as OS X has not re-used the directory and cataloged the information yet. Amazing! Isn't it?
